Ways for resolving disputes 解决纠纷方式
A: It is inevitable 1 to have some disputes in doing international trade business. Could you tell me how to resolve the dispute in your country?
国际贸易中偶尔发生纠纷是避免不了的事。在贵国是怎样解决这些纠纷的呢？
B: These are several ways. The best is to achieve consensus 2 through consultation 3.
有多种方式。最好的方法是通过双方协商圆满解决。
A: Would you seek for the legal means if the consultation can't help resolve the dispute?
如果协商解决不了的话，通过法律就是说依靠国家权力来解决吗？
B: Litigation is of course a way of resolving dispute. But actually we don't use it frequently.
诉讼当然是解决纠纷的一种手段。不过实际上很少使用这种方式。
A: Then what should we do?
那怎么办呢？
B: Usually through arbitration 4.
一般来说是通过仲裁来解决。
A: Does the final judgement by arbitration have binding 5 force on the parties concerned?
那仲裁做出的决定是终决，对当事人是有约束力的吧。
B: Yes.
是的。
1.“binding”是“有约束力的，负有义务”的意思，例如：This regulation is binding on everybody. （本规则皆须遵守。） 2. “legal means”是“法律途径”的意思，“means”有“方法，手段”的意思，例如：means of fiscal 6 policy（财政政策手段。）
1 inevitable
adj.不可避免的，必然发生的
- Mary was wearing her inevitable large hat.玛丽戴着她总是戴的那顶大帽子。
- The defeat had inevitable consequences for British policy.战败对英国政策不可避免地产生了影响。
2 consensus
n.(意见等的)一致，一致同意，共识
- Can we reach a consensus on this issue?我们能在这个问题上取得一致意见吗？
- What is the consensus of opinion at the afternoon meeting?下午会议上一致的意见是什么？
3 consultation
n.咨询；商量；商议；会议
- The company has promised wide consultation on its expansion plans.该公司允诺就其扩展计划广泛征求意见。
- The scheme was developed in close consultation with the local community.该计划是在同当地社区密切磋商中逐渐形成的。
4 arbitration
n.调停，仲裁
- The wage disagreement is under arbitration.工资纠纷正在仲裁中。
- Both sides have agreed that the arbitration will be binding.双方都赞同仲裁具有约束力。
